Terms of Service

These Terms of Service ("Terms") govern your use of the American Filter USA website and any water testing, sales, financing referral, and installation services provided by American Filter USA LLC ("we," "us," "our"). By using this site or requesting a water test, you agree to these Terms.

1. Free water test

Our in-home water test is free and carries no obligation to purchase. It is offered to help us recommend appropriate equipment. Results reflect conditions at the time and point of sampling and are not a certified laboratory analysis unless expressly stated in writing.

2. Estimates and pricing

Prices published on this website are for standard installations in our service area and are subject to confirmation after an on-site assessment. Final pricing may vary based on your home's plumbing, water conditions, permitting, and any additional work required (for example, septic discharge routing).

A written estimate is valid for the period stated on it; if none is stated, it is valid for 30 days.

3. Installation and scope of work

Installation is performed by us or our authorized installers. The scope of work, equipment model, and price are set out in your signed agreement. Work outside that scope requires a written change order.

You are responsible for providing safe, reasonable access and for disclosing known conditions (electrical, plumbing, septic, or structural) that may affect the work.

4. Texas septic requirements

For homes served by an on-site sewage facility (septic), the softeners we install use demand-initiated regeneration in accordance with Texas Health & Safety Code §366.013 and related rules. Site-specific discharge routing is determined during assessment and reflected in your agreement.

5. Water treatment claims

Our equipment reduces certain substances in water as described on the relevant product pages. We describe the reduction of substances; we do not represent that any substance is entirely removed, eliminated, or prevented. Actual performance depends on your incoming water chemistry, water use, maintenance, and configuration.

6. Warranty

Equipment carries the manufacturer's limited warranty for the specific model installed. We separately warrant our installation workmanship as stated in your signed agreement. Coverage may require proper maintenance and approved consumables. The controlling terms are those in your written agreement and the manufacturer's warranty documentation.

7. Financing

Financing, where offered, is provided by third-party lending partners, not by us. Any monthly payment figures on this website are illustrative estimates, not an offer of credit. Your actual rate, term, and payment depend on the lender's approval and disclosures. Review all financing documents before signing.

8. Cancellation

You may have the right to cancel a home-solicitation sale within the period required by Texas law. Your signed agreement describes the applicable cancellation rights and procedure. Nothing here waives a non-waivable consumer right.

9. Dispute resolution and arbitration

The parties agree to attempt to resolve disputes informally first. If a dispute cannot be resolved, it may be subject to binding arbitration on an individual basis as set out in your signed agreement, and, to the extent permitted by law, you and we waive the right to a jury trial and to participate in a class action. Review the arbitration terms in your agreement before signing; they are controlling.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of the services or these Terms is limited to the amount you paid for the services at issue. We are not liable for indirect, incidental, or consequential damages.

11. Changes and governing law

We may update these Terms; the version posted here with the date above is current. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
